The Monthly Leaderboard Giveaway

Eligibility.

The Monthly Leaderboard Giveaway at Bonanzle (henceforth referred to as "The Event") is open to U.S. and Canada residents who are registered Bonanzle members in good standing. Individuals without membership in Bonanzle.com are not entitled to any benefit or proceeds arising from the Event. Good standing means a member has fulfilled the requirements for Bonanzle membership and has neither voluntarily withdrawn nor has been terminated or suspended from membership, and the account is not in delinquency. By participating in the Event, you agree that you meet these eligibility requirements and the following terms and conditions. Employees of Bonanzle as well as the immediate family (spouse, parents, siblings, and children) and household members are not eligible to participate (gyp!). Violating these and other rules may cause the immediate suspension or cancellation of your account, and void your rights to receive any prizes you may have won. The Event is void where prohibited.

Referral Credits.

You cannot create multiple accounts or accounts for other people, including but not limited to friends, family, classmates, and coworkers. To receive referral credits, each new member that you refer must be a unique person who has not signed up in the past, or have already accepted a referral by another participant, and you may not refer yourself. There are no geographic restrictions on your referrals. It will be the sole discretion of Bonanzle to determine users who have violated this polilcy.

Disqualifications.

Bonanzle may, in its sole discretion, prohibit or ban any person from participating in the contest whom they believe to be abusing the contest rules, which may include, but not limited to, entering false information, distributing chain letters or other unsolicited electronic mass communication such as spamming, creating multiple accounts, submitting false or fictional referrals, or breaching other terms and conditions. Any such disqualification will result in the forfeiture of all accrued referral credits from the participants.

If, in Bonanzle's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Event or the Referral Credits, or if a computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Event, Bonanzle reserves the right at its sole discretion to disqualify any individual involved in any such harmful or illegal activities, and to modify or suspend the Event, or to terminate the Event in its entirety.

Modifications.

Bonanzle reserves the right to modify any of the terms and conditions set forth herein - including, but not limited to, the methods through which participants may earn referral credits and the amount of credit that can be earned by referring friends - at any time, with or without notice, even though these changes may affect a participant's ability to receive their credit. Participants are responsible for remaining knowledgeable and keeping apprised of any changes of terms and conditions hereof.

Privacy.

To learn how the personal information collected in connection with the Event may be used, individuals should read the terms of Bonanzle's Privacy Policy which are incorporated herein by reference.

Miscellaneous.

Bonanzle is not responsible for any incorrect or inaccurate information supplied by the members or referred friends while participating in the Event. All questions or disputes regarding eligibility for the Event, earning of Referral Credits, or a member's compliance with these terms and conditions will be resolved by Bonanzle in its sole discretion.

Caution: Any attempt by a participant to deliberately damage any Bonanzle website or other components or undermine the legitimate operation of the Event is a violation of criminal and civil laws and should such an attempt be made, Bonanzle reserves the right to seek damages from any such participant to the fullest extent permitted by law.

General Release and Limitation of Liability.

By participating in this Event, you agree to waive any right to claim ambiguity in these terms and conditions and release, indemnify, and hold harmless Bonanzle and all of its subsidiaries, affiliates, shareholders, directors, officers, employees, representatives, and agents (collectively "Releases") from and against any and all liabilities whatsoever and howsoever arise, and waive any and all causes of action, related to any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the event or acceptance, possession, use, misuse, or nonuse of any referral credits participants receive or believe to receive. This limitation of liability applies to all loses, costs, expenses, and damages of any kind, including (without limitation) compensatory, general, direct, indirect, special, incidental, punitive or consequential damages, loss of data, income or profit.

Disclaimers.

Participants agree that Releases have not made nor are in any manner responsible or liable for any warranty, representation, condition, or guarantee, whether statutory, express or implied (including, but not limited to, implied warranties of merchantability, merchantable quality, title, and fitness for a particular purpose), in fact or in law relative to the event. Without limiting the generality of the foregoing, releases do not make any express or implied warranties or representations with respect to the Bonanzle site, and Releases shall not be liable for the consequences of any interruptions or errors related thereto. Releases are not responsible for printing or typographical errors in any materials related to the Event; for stolen, lost, late, or misdirected Referral Credit; for referrals, transactions, and/or emails that are lost, misdirected, failed to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human, or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any website associated with this Event, or process any transaction thereon.

Arbitration.

Except where prohibited, participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Event shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (i.e., only costs associated with participating in the Event), but shall not include attorneys fees under any circumstances; and (c) member hereby waives all rights to claim punitive, incidental, and consequential damages.

Severability.

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these terms and conditions, which will otherwise remain in full force and effect.
